Wisconsin widow tries to sell villa with patio in violation of deed restriction

A widow in Wisconsin is apparently trying to sell a patio villa that is violating the deed restriction.

The 1984 Peaceful Path home in the Fairhope Villas of St. James Village was the subject of a public hearing Friday morning before the Community Development District 8 Board of Supervisors.

The house has been listed by Kathy Collins of Properties of The Villages and a “pending” sale sign is displayed in the patio villa.

A sale is underway at the Villa Patio at 1984 Peaceful Path where the house is in violation of a deed restriction.

During the public hearing, the CDD 8 supervisory board viewed photographs of rocks placed as ground cover at the house. The owner laid the stone without the approval of the architectural review board and tried, without success, to retroactively obtain the CRA blessing. Rock is only allowed as an accent in the landscaping of the patio villas in CDD 8.

“They tried to do a good job with it. But it’s a violation, ”said CDD 8 chairman Larry McMurry.

The villa with patio was purchased for $ 160,000 in 2013 by Richard and Carol Johnson.

Richard Johnson died on April 18 at the age of 79 in Corner stone village hospice house.

Community Standards has been in contact with Carol Johnson and has hopes that she will attend Friday’s meeting at the SeaBreeze Recreation Center. However, she remains in Wisconsin and did not make the trip for the public hearing. The tax bill for the property is mailed to an address in Madison, Wis.

Supervisors appeared unaware that there was a pending sale sign posted in the patio villa. However, supervisors asked hypothetical questions about the sale of property found in violation of the deed’s restrictions in the villages.

“Is the violation registered with the county?” Asked supervisor Sal Torname.

District attorney Mark Brionez said the violations are not being registered with the county. He also indicated that the breach likely wouldn’t surface during a title search.

“If there is a sale, the buyer doesn’t know it unless the seller lets them know,” Brionez told the board.

The board has agreed to give Johnson 30 days to bring the property into compliance. If it is not brought into compliance, it faces a series of fines.
